Privacy Policy, i.e. Rules for the Processing of Personal Data by the Pomeranian Regional Tourist Organisation via the website www.pomorskietours.pl as information pursuant to ART. 13 PAR. 1 and 2 of the General Data Protection Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC

 

PERSONAL DATA CONTROLLER

1. The controller of your personal data is the Pomeranian Regional Tourist Organisation

3. The controller uses technical and organisational measures to ensure the protection of personal data being processed, appropriate to the risks and categories of data being protected, and in particular protects the data against unauthorised access, removal by an unauthorised person, processing in violation of applicable regulations, and alteration, loss, damage or destruction.

 

PURPOSE AND DURATION OF PROCESSING

4. The Controller processes your personal data for the following purposes:

a) to offer you our services – trips (direct marketing) (legal basis: Article 6(1)(f) of the GDPR);
b) to handle complaints in connection with contracts concluded with us and orders placed (legal basis: Article 6(1)(b) of the GDPR);
c) to comply with statutory requirements imposed on us, in particular those arising from tax and accounting regulations (legal basis: Article 6(1)(c) of the GDPR);
d) contacting you at the telephone number or email address provided in order to respond to your enquiries (based on Article 6(1)(f) of the GDPR, as the so-called legitimate interest of the controller);
e) pursuing claims arising from our business activities and, consequently, processing your data - the right of the data controller who is an entrepreneur (based on Article 6(1)(b) and (f) of the GDPR, as the so-called legitimate interest of the controller, which is to pursue our claims and defend our rights).

5. Providing personal data may be necessary for the conclusion and performance of the Cooperation Agreement or the services we offer.
6. Your personal data will be processed for a period justified for the purposes indicated in section 4, i.e.:

a) for the duration of the service provision, until the withdrawal of consent or the lodging of an effective objection to the processing of data in cases where the legal basis for the processing of data is the legitimate interest of the the Controller;
b) the period of data processing may be extended if processing is necessary to establish and pursue any claims or defend against them, and after that time only if and to the extent required by law. Thus, personal data provided by you for the following purposes will be processed:

- conclusion and performance of the contract will be processed for the duration of the contract and until the expiry of the limitation period for bringing claims;
- consideration of complaints will be processed for 1 year after the expiry of the warranty period or settlement of the complaint;
- archiving settlement documents will be processed until the expiry of the tax liability limitation period;
- handling enquiries and other requests addressed to us, including ensuring the accountability of the activities carried out by the Controller for a period of 3 years.

8. Your data may also be prepared for entities authorised to obtain it under applicable law, e.g. law enforcement authorities if requested by an authority on an appropriate legal basis (e.g. for the purposes of ongoing criminal proceedings).

RIGHT TO CONTROL, ACCESS AND CORRECT YOUR DATA

12. In connection with the processing of your personal data, you have the following rights:

a) the right to access your personal data,
b) the right to rectify your personal data if it is inaccurate,
c) the right to erase your personal data or restrict its processing,
d) the right to object to the processing of your personal data,
e) the right to data portability.

13. The supervisory authority for personal data is the Polish Data Protection Commissioner. You have the right to lodge a complaint with the supervisory authority.

14. If you provide your personal data for the purpose of concluding a contract, the provision of your personal data is a condition for the conclusion of this Agreement. The provision of personal data in this situation is voluntary, but failure to provide such data will result in the inability to conclude the contract.
